Terms and conditions of sale
Article 1 - Dealer designation
The seller is the present site opus-nova.com, on which depends its online store store.opus-nova.com. These websites are published by OPUS NOVA, SASU with capital of €252,000, registered in the Paris Trade and Companies Register under number 914 859 533, with registered office at 50 avenue des Champs-Elysées 75008 Paris.
Article 2 - General provisions
2.1. Purpose of this agreement
These General Terms and Conditions of Sale (hereinafter referred to as the "GTCS") apply exclusively to the online sale of OPUS NOVA products on its website opus-nova.com linked to its store store.opus-nova.com, (hereinafter referred to as the "Site") which is open to the public.
2.2. Scope of application of the GCS
The General Terms and Conditions of Sale govern exclusively the online sale of OPUS NOVA products to buyers who are consumers (hereinafter referred to as consumers) and, together with the online order, constitute the contractual documents binding on the parties, to the exclusion of all other documents, prospectuses, catalogs or photographs of the products, which are for information purposes only.
The GCS apply exclusively to products delivered to consumers established in France and/or in a member state of the European Union.
The GTC are written in French, as is all contractual information mentioned on the site.
French is the prevailing language in all respects, particularly in the event of discrepancies between any translated versions, or in the event of any difficulty of interpretation.
All versions of these GTC in any other language are provided for information purposes only and are not binding on the parties.
2.3. Availability and enforceability of the GCS
The General Terms and Conditions are made directly available to consumers on the OPUS NOVA website. The terms and conditions are binding on the consumer, who acknowledges that he/she has read them and accepted them before placing an order, by checking a box provided for this purpose when placing an order.
Validation of the order by its confirmation implies acceptance by the purchaser of the GTC in force on the day of the order, the conservation and reproduction of which are ensured by OPUS NOVA in accordance with article 1127-2 of the Civil Code (former C. civ., art. 1369-4).
2.4. Modification of the GTC
These terms and conditions were updated on September 19, 2024.
OPUS NOVA reserves the right to modify its GTC at any time.
In the event of modification of the GTCS, the applicable GTCS are those in force on the date of the order, a copy of which, dated to that date, can be given to the consumer on request.
2.5. Validity of the clauses of the GTCS
The nullity of a contractual clause does not entail the nullity of the GCS. The temporary or permanent non-application of one or more clauses of the GCS by OPUS NOVA shall not constitute a waiver of the other clauses of the GCS, which shall remain in full force and effect.
Article 3 - Products on sale
3.1 Features
The products offered for sale in the catalog published on the site are each described in terms of their essential characteristics within the meaning of article L. 111-1 of the French Consumer Code.
The photographs illustrating the products do not constitute a contractual document.
3.2. Product use
The site sells cosmetics for skincare as well as dietary supplements.
Some of the products offered on the site may be highly concentrated or very powerful, or may be dangerous if used incorrectly or if allergies are known to exist. OPUS NOVA provides consumers with the information they need to use the products correctly.
The information provided on the products is not medical information.
OPUS NOVA cannot be held responsible for damage caused by misuse of the products sold on its site or by failure to observe the precautions for use.
3.3 Conformity
The products comply with current regulations concerning personal health and safety, fair trading and consumer protection at the time they are placed on the market. The products comply with French legal requirements in force at the time they are placed on the market.
3.4. Stock availability
Products are offered and delivered while stocks last.
In the event of unavailability of the product ordered, OPUS NOVA will immediately inform the buyer and may offer a product of equivalent quality and price or, failing that, a voucher for the amount of the order to be used for any future order.
If the buyer does not agree, OPUS NOVA will refund the sums paid within 10 working days.
Apart from reimbursement of the price of the unavailable product, OPUS NOVA is not liable for any compensation for cancellation, unless it is personally responsible for the non-performance of the contract.
3.5. Product resale
OPUS NOVA products may not be resold on a website other than the OPUS NOVA website, nor on a marketplace.
Products sold on the site cannot be reconditioned and resold.
Article 4 - Prices
4.1. Selling prices
In accordance with article L. 112-1 of the French Consumer Code, sales prices are indicated for each product in the electronic catalog in euros, including all taxes, but excluding delivery and transport costs, which are mentioned before the order is validated and invoiced in addition.
The total amount due by the consumer is indicated on the order confirmation page.
The selling price of the product is that in force on the day of the order.
The sale price of products does not include shipping costs, which are invoiced in addition to the price.
In the event of a price promotion, OPUS NOVA undertakes to apply the promotional price to all orders placed during the period in which the promotion is advertised.
4.2 Modification
OPUS NOVA reserves the right to modify its prices at any time, while guaranteeing the consumer the application of the price in effect on the day of the order.
4.3. Fees
The additional costs of transport, delivery or postage (to which must be added any other costs borne by the seller), of which the customer has been made aware before placing the order, are set out on the order summary.
Article 5 - Offers and promotions
5.1. domain
The online sales offers presented on the site are reserved for consumers residing in France and/or in a member country of the European Union and for deliveries in these same zones.
5.2. Duration
The online sales offers presented on the site are valid for as long as the products appear in the electronic catalog and while stocks last, unless otherwise indicated.
5.3. Acceptance
Acceptance of the offer by the consumer is validated by confirmation of the order.
Article 6 - Ordering
6.1. Contract conclusion stages
To place an order, the consumer fills his or her virtual basket with the products selected and the quantities required, then clicks on the "Order" button and provides the delivery and payment details.
Before clicking on the "Confirm order" button, customers can check the details of their order and its total price, and return to previous pages to correct any errors or modify their order.
Confirmation of the order implies acceptance of the GTC and forms the contract.
An e-mail acknowledging receipt of the order and payment will be sent by OPUS NOVA as soon as possible.
6.2. Order modification
Any modification of the order by the consumer after confirmation of the order is subject to acceptance by the professional seller.
OPUS NOVA reserves the right to make modifications to the product ordered in line with technical developments, in accordance with article R. 212-4 of the French Consumer Code.
6.3. Order validation
OPUS NOVA reserves the right to refuse any order for legitimate reasons, and more particularly if the quantities of products ordered are abnormally high for buyers who are consumers. OPUS NOVA may also refuse or delay the processing of an order if it suspects fraud of any kind, such as identity theft or theft of means of payment.
Article 7 - Sales contract
7.1. Conclusion of sale
The sales contract is formed when the consumer sends confirmation of his/her order.
7.2. Archiving
Communications, order summaries and invoices are archived on a reliable and durable medium so as to constitute a faithful and durable copy in accordance with article 1360 of the French Civil Code (formerly C. civ., art. 1348). These communications, order summaries and invoices may be produced as proof of the contract.
Article 8 - Payment of orders
8.1. Eligibility
The price is payable in full once the order has been confirmed. Payment is made immediately upon ordering by credit card.
8.2. Payment security
Payment is made via the secure server of our partner, STRIPE, a secure payment operator. Credit card numbers are encrypted.
This implies that no banking information concerning the buyer transits or is stored on the OPUS NOVA site.
Article 9 - Delivery of orders
9.1. Definition
Delivery refers to the transfer of physical possession of the goods to the consumer.
9.2. Shipping time
Under normal conditions, OPUS NOVA will process orders as quickly as possible from Monday to Friday, excluding public holidays. OPUS NOVA undertakes to dispatch orders within 24 hours of order validation, subject to stock availability.
9.3. Delivery time
The prepared order will be delivered to the carrier selected by the customer.
Delivery times for orders to French overseas territories or abroad vary according to the region or country of delivery.
In order to facilitate delivery of the order by the carrier, the customer undertakes to make every effort to ensure that the parcel is delivered: name visible on the letterbox, transmission of the key code and telephone number.
9.4. Delay in delivery
In the event of a delivery delay of more than 5 working days, the customer must inform OPUS NOVA's customer service department, which will take the necessary and appropriate action.
9.5. Place of delivery
Products are delivered to the address indicated by the customer when ordering.
9.6. Product conformity
If the product does not conform to the order, the consumer must send a complaint to the professional seller in order to obtain the replacement of the product or possibly the resolution of the sale.
9.7. Transfer of ownership
On delivery of the product, ownership of the product is transferred to the purchaser, except in cases where full payment of the price has not been received with the order.
Article 10 - Product returns and right of withdrawal
The consumer has a right of return of fourteen days from receipt of his order to return any item that does not suit him and request an exchange or refund, with the exception of return costs which remain at his expense.
The right of withdrawal can be exercised by contacting our customer service department directly from our website in the "Contact us" section. We will immediately send you an acknowledgement of receipt of the cancellation on a durable medium (e.g. by e-mail).
Returns are to be made in their original condition and complete to enable them to be remarketed as new. Any product opened or damaged by the consumer will not be accepted.
In the event of withdrawal, OPUS NOVA will reimburse all payments received by re-crediting the consumer's credit card.
OPUS NOVA may defer reimbursement until receipt and verification of the products.
Article 11 - Processing of personal data
OPUS NOVA processes consumer information in accordance with its Privacy Policy.
Article 12 - Dispute resolution
OPUS NOVA cannot be held responsible for damage resulting from improper use of its products.
In the event of a dispute, you should first contact the company's customer service department by e-mail (contact@opus-nova.com) to try to resolve the matter informally.
Article 13 - Applicable law
These terms and conditions are governed by French law.
